This platform is owned by Innovaryx, which makes these terms and conditions available to users, describing the rules and regulations for the use of the platform. Therefore, by accepting this policy, users acknowledge that they have read and understood the contents of these terms and conditions and agree to be bound by the provisions outlined in this document. By accessing the platform, we assume that you accept these terms and conditions in full. Do not continue to use the platform if you do not accept all the terms and conditions set forth in this document.

Terms of Use and Access to the Innovaryx Portal
El portal de Innovaryx es de propiedad de Innovaryx S.A.S., en adelante Innovaryx. Su acceso y utilización, así como la participación en los foros, plataformas, contenidos o escenarios de interacción que ofrece, es gratuito, y presupone que usted ha comprendido y aceptado estos términos y condiciones. En adelante, los usuarios del portal serán identificados como “el usuario”, quienes para poder acceder a él, deben ser mayores de edad o estar autorizados por sus representantes legales.
Este portal cuenta con altos estándares de seguridad, usabilidad y experiencia de usuario para el cliente final. La misión de Innovaryx es impulsar el éxito empresarial mediante la integración de tecnologías innovadoras, mientras mantenemos un enfoque centrado en el cliente y comprometido con prácticas sostenibles. Nos esforzamos por proporcionar soluciones tecnológicas de vanguardia y asesoramiento estratégico que no solo optimicen la eficiencia y competitividad de nuestros clientes, sino que también fomenten el cuidado ambiental y el impacto social positivo. Buscamos ser líderes en la industria al ofrecer servicios de alta calidad, respaldados por el conocimiento de nuestros expertos y nuestra capacidad para adaptarnos a las necesidades y presupuestos de cada cliente.
Por medio del Portal de Innovaryx se prestan servicios y soluciones integrales que tienen como finalidad brindar al usuario todo tipo de información relacionada con los servicios y soluciones de la compañía, que incluyen, entre otros recursos: noticias, artículos, publicaciones de interés, programación, convocatorias, ofertas y demás información vinculada con las líneas de negocio de Innovaryx:
a) Datos y Analítica.
b) Nube y Plataforma.
c) Inteligencia Artificial y Automatización.
d) Ciberseguridad.
e) Arquitectura de Software.
f) Desarrollo de Software a Medida.
Además del portal principal (www.innovaryx.com), Innovaryx cuenta con diferentes subdominios, plataformas y productos digitales que forman parte de su ecosistema tecnológico, entre los cuales se incluyen —sin limitarse a— los siguientes:
* Inno-Obra (obra.innovaryx.com): plataforma destinada a la gestión, planificación y seguimiento de proyectos de obra civil y tecnológica.
* Otros subdominios, micrositios o productos complementarios que Innovaryx desarrolle o ponga a disposición en el futuro, los cuales estarán igualmente sujetos a los presentes Términos y Condiciones.
El acceso y uso de cualquiera de estos subdominios o productos implica la aceptación expresa de esta Política de Términos y Condiciones, así como de las políticas específicas que cada servicio o solución pueda requerir.
Information about Third-Party Digital Platforms or Web Links
Innovaryx makes no statement regarding the content of Digital Platforms or web links other than the Innovaryx Portal, i.e., strategic allies or third parties. Therefore, it is informed that when the user accesses a Digital Platform that is not from Innovaryx, the latter has no control over the content of such platform. The user accepts that Innovaryx is not responsible for any content, associated link, resource, or service related to the Digital Platform or web link of a strategic ally or third party. Likewise, the user accepts that Innovaryx will not be responsible for any loss or damage of any kind arising from the use made of the content of a strategic ally or third party. The links and access to Digital Platforms or web links of strategic allies or third parties included in the Innovaryx Portal are provided exclusively to link or integrate services and solutions that optimize and offer better amenities for the user. Innovaryx is not responsible for information found outside the Innovaryx Portal and not directly managed by its administrator. The external connections appearing on the Innovaryx Portal are intended to unify and inform the user about the existence of other functionalities and sources capable of expanding the contents offered.
License and Non-Licensing
Unless otherwise indicated, Innovaryx or its licensors own the intellectual property rights of the Innovaryx Portal, and the content provided through this platform, including websites, microservices, services, solutions, existing or future applications, and elements such as our logos, APIs (Application Programming Interface), source code, databases. You may not manipulate these elements or use them without authorization. Our Digital Platforms or websites, services, and comprehensive solutions are protected by copyright and trademark. Nothing grants you the right to use the name of Innovaryx, or its trademarks, logos, corporate templates, domain names, and other distinctive features of the Innovaryx brand. All comments or suggestions you provide regarding Innovaryx are entirely voluntary, and we will have total freedom to use such comments and suggestions as we see fit and without incurring any obligation to you. The use of the Innovaryx Portal is subject to the restrictions set forth in our Terms and Conditions Policy. Prohibited actions include: a) Accessing, manipulating, or using non-public areas of the Innovaryx Portal, including Innovaryx's application architecture, data, and technology. b) Disabling, interfering with, or attempting to circumvent any of the security-related features of the Innovaryx Portal, as well as exploring, scanning, and testing the vulnerability of our information systems. c) Copying, modifying, creating a derivative work, reverse engineering, disassembling, or attempting in any other way to discover any source code or content of the Innovaryx Portal. d) Using Innovaryx's comprehensive services and solutions to send information with manipulated, misleading, or false origin identification. e) Inferring or disrupting access to the Innovaryx Portal for any user. f) Selling, renting, or sublicensing the Innovaryx Portal. h) Reproducing, duplicating, copying material, or content from the Innovaryx Portal. j) Redistributing Innovaryx's contents or its Innovaryx Portal. Innovaryx does not grant any license or authorization of any kind, regarding its intellectual property rights (copyrights and industrial property), image, and other distinctive signs, or any other property or right related to the Innovaryx Portal, services, or contents. The user has no right to resell or commercially use the Innovaryx Portal or its contents, nor any right to copy or use any service, solution, descriptions, prices, or other information hosted on the Innovaryx Portal. The use of the Innovaryx Portal does not grant any rights except as provided in our Terms and Conditions Policy or in the contracted services and solutions.
Intellectual Property
Innovaryx respects the intellectual property rights of our content providers, strategic allies, and third parties, and expects our users to do the same when using our services and comprehensive solutions. We reserve the right to suspend, disable, or delete user accounts that repeatedly infringe or are repeatedly accused of infringing the copyrights, trademarks, or other intellectual property rights of others. Using our services does not grant ownership of any intellectual property rights of our services, solutions, or the content you access. Any suggestions, ideas, or feedback related to our services and solutions will always be welcome. When you submit any feedback, you grant us the right to use it without any restrictions or compensation. By accepting your feedback, Innovaryx does not waive the right to use similar or related opinions that have been previously published on the Innovryx Portal, developed by its users, strategic allies, or third parties, or obtained from other sources.
User Exclusion Right
Innovaryx may terminate or suspend your access to the service permanently or temporarily without prior notice for any reason, even if, at our sole discretion, you violate any provision of our Terms and Conditions Policy of the Innovaryx Portal or any applicable law or regulation. Innovaryx may discontinue the use and request the cancellation of your account or any service at any time. Likewise, all judicial or administrative actions available may be exercised to demand the responsibilities of any provision of this Innovaryx Portal Terms and Conditions Policy that arise from a user's breach.
Limitation and Exoneration of Innovaryx's Liability
Innovaryx shall not be liable for events beyond its control, nor for any damages that may arise from the use of the information provided through the service. We are not responsible for any damage, harm, or loss to the User caused by system failures not attributable to the Company, on the server, or on the Internet. Nor shall we be responsible for any virus that may infect the User's equipment as a result of access, or from any transfer of data, files, images, texts, or audio contained therein. Users may not impute any liability or demand payment for lost profits due to technical difficulties or failures in systems or the Internet. Innovaryx does not guarantee continuous or uninterrupted access and use of its site. The system may eventually be unavailable due to technical difficulties or Internet failures, or for any other reason; in such cases, we will endeavor to restore it as quickly as possible, without incurring any liability. Nor shall we be responsible for errors or omissions on our platform. Innovaryx excludes, to the extent permitted by applicable law in the Republic of Colombia, any liability for damages of any kind arising from: a) The impossibility of access to the platform or the lack of truthfulness, accuracy, or timeliness of the content, as well as the existence of defects and flaws of all kinds of the content transmitted, disseminated, stored, made available to be accessed through the platform or the services offered in a traditional or electronic manner. b) The presence of viruses or other elements in the content that may alter the computer systems, electronic documents, or user data. c) Non-compliance with laws, good faith, public order, traffic usages, and these terms and conditions as a result of the incorrect use of the platform. The User agrees to defend, indemnify, and hold harmless Innovaryx, its employees, and/or its subsidiaries (the "Indemnified") against any claim, expense, liability, loss, cost, and damage, including attorney's fees, incurred by the Indemnified, such as: i) In connection with the use of the platform or any web pages with hyperlinks on the platform that are not permitted or do not conform to the purposes pursued by Innovaryx, or ii) Arising from the content provided by the User. Innovaryx does not guarantee or assume any liability for damages of any kind that may arise from: a) The operation, availability, accessibility, or continuity of linked sites; b) The maintenance of services, information, data, files, products, and any kind of material existing on linked sites; c) The provision or transmission of services, information, data, files, products, and any kind of material existing on linked sites. Likewise, any liability for damages of any kind arising from the presence of viruses or other elements in the content that may alter the computer system, electronic documents, or files of users is excluded.
Applicable Law and Jurisdiction
The policies and conditions of access and use established herein, and any conflicts that may arise regarding their interpretation, use, scope, and termination, may be resolved through a conciliation center in the first instance. If conciliation is not possible, they shall be governed by Colombian law and submitted to the Colombian Judges and Courts. The web pages, their design, and graphical presentation are protected by the provisions of Law 23 of 1982, articles 12 and 30, and Decision 351 of the Cartagena Agreement (for the Colombian case), and by the provisions of the Copyright Act of 1976 of the United States of America.
Actions in Case of Breach
Innovaryx may take legal actions of any kind to demand liability from the user arising from the breach of these terms and conditions.

Privacy Notice
All data registered on the Innovaryx Portal will be processed for the purposes of data collection as provided in the Innovaryx Data Privacy Policy. In compliance with current regulations, appropriate technical measures of security and confidentiality have been adopted to prevent alteration, loss, unauthorized treatment, or access that may affect the integrity, confidentiality, and availability of personal data.
